EU: Commission issues reasoned opinions against 15 Member States for failure to transpose Whistleblowing Directive

The European Commission announced, on 15 July 2022, that it had taken further steps in its infringement procedure against 15 Member States for failing to transpose the Directive on the Protection of Persons who Report Breaches of Union Law (Directive (EU) 2019/1937) ('the Whistleblowing Directive') before 17 December 2021. In particular, following formal notices issued in January 2022, the Commission noted that 15 Member States have not yet adopted transposition measures. As such, the Commission concluded that it had issued reasoned opinions, to which Member States have two months to reply. If the replies are not satisfactory, the Commission indicated that it may refer the concerned Member States to the Court of Justice of the European Union.

In this regard, the Commission confirmed that the 15 Member States include Bulgaria, Czech Republic, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Luxembourg, Netherlands, Poland, Slovakia, and Spain.
