EU: EDPB publishes 75th plenary meeting agenda, EDPB to discuss draft guidelines, WhatsApp decision, and EU-US DPF

The European Data Protection Board ('EDPB') published, on 13 February 2023, its 75th plenary meeting agenda, which will take place on 14 and 15 February 2023. In particular, the agenda outlines that the EDPB will discuss the guidelines listed below, following their public consultation:

  • Guidelines 05/2021 on the Interplay between the Application of Article 3 and the Provisions on International Transfers as per Chapter V of the GDPR;
  • Guidelines 07/2022 on Certification as a Tool for Transfers; and
  • Guidelines 03/2022 on Deceptive Design Patterns in Social Media Platform Interfaces: Practical Recommendations.

In addition, the agenda notes that the EDPB will follow up on its binding decision, issued on 5 December 2022, on the basis of Article 65(1)(a) of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'), on the dispute submitted by the Data Protection Commission ('DPC') in relation to #WhatsApp Ireland Limited.

Notably, the agenda details that the EDPB will also present the state of play of the EU - US Data Protection Framework. / #dataguidance
